PodFolio Terms and Conditions

These terms govern your use of the PodFolio app for Android, the web version at app.podfolio.pcngroup.ch and this website. By using PodFolio you accept them.

1. Who we are

PodFolio is developed and published by PCN Group di Niccolò Cavallini, Rigistrasse 28, 8006 Zürich, Switzerland ("PCN Group", "we", "us"). For any question, write to info@pcngroup.ch.

2. The service

PodFolio is a podcast player. It lets you search public podcast directories, subscribe to podcast RSS feeds, stream or download episodes, and sync your library and progress across your devices.

PodFolio does not produce or host podcasts: it reads them from the feeds their creators and publishers make public.

3. Account and sync

  • You can use PodFolio without an account. To sync subscriptions, progress and queue across devices, and to use Premium in the web version, sign in with your Google account.
  • You are responsible for access to your Google account and for what happens with it in PodFolio.
  • We do our best to keep sync reliable, but we can't guarantee it is always available or free of errors. We suggest exporting your subscriptions to an OPML file from time to time.

4. Free trial and PodFolio Premium

  • When you first use PodFolio you get a 14-day free trial with every feature, without entering a payment card.
  • After the trial, you need PodFolio Premium to keep using the app. Without Premium the app stays locked, but your library and downloads stay on your device.
  • Premium is a one-time purchase, not a subscription: there are no renewals and no recurring charges. The price is the one shown on Google Play when you buy (CHF 3.99 in Switzerland, the equivalent in local currency elsewhere), with taxes as set out by Google Play.
  • The purchase is made through Google Play, which handles the payment under its own terms. Premium stays linked to your Google account: you get it back after reinstalling the app ("Restore purchase") and, by signing in with the same account, in the web version too.
  • Premium unlocks PodFolio as we offer it over time, for as long as we offer it. Features may change (see section 11).

5. Refunds and right of withdrawal

Refund requests are handled through Google Play, under its rules. Any rights the law of your country gives you as a consumer, and that cannot be excluded by contract, remain unaffected. If you have a problem with a purchase you can also write to us and we will look for a solution.

6. Third-party content

  • Podcasts, episodes, artwork and descriptions belong to their creators and publishers, who are responsible for them. We don't control or endorse them, and we don't guarantee that they are accurate, lawful or always available.
  • PodFolio shows no ads. Ads that some creators place inside their own episodes are part of the audio and stay.
  • If you think a piece of content is unlawful, report it to the podcast's publisher. You can also write to us: where the law requires it, we will stop showing it in PodFolio.

7. Il Post and other outside services

  • Il Post's subscriber-only podcasts are available only with your own active subscription and your own credentials. Your credentials are sent only to Il Post to sign in; in the web version they pass through a proxy we run, which neither stores nor logs them. Your use of that content is also subject to Il Post's terms.
  • Some podcasts are only available on Spotify: PodFolio opens them in the Spotify app or website.
  • PodFolio is not affiliated with or endorsed by Il Post, Spotify, Google, Apple or the podcast publishers. Their names and trademarks belong to their owners.
  • These services can change or stop at any time; if they do, the PodFolio features that depend on them may stop working.

8. Shared links

When you share a podcast or an episode, PodFolio creates a public link that contains the feed address and, if you choose, the minute to start from. Anyone who gets the link can open it. You are responsible for what you share. Subscriber-only podcasts are never turned into shareable links.

9. Acceptable use

You may use PodFolio to listen to podcasts for your personal use. You may not:

  • get around the free trial, Premium or other technical limits of the app;
  • overload or misuse our services, including the web version's proxy;
  • use PodFolio for unlawful purposes or to distribute content in breach of its owners' rights;
  • resell PodFolio or use it commercially without our written agreement.

10. Intellectual property

The app, the website, the PodFolio name and the logo belong to PCN Group. We grant you a personal, non-exclusive, non-transferable licence to use PodFolio under these terms. Any rights the law gives you in any case remain unaffected.

11. Availability and changes to the service

We develop PodFolio continuously: we may add, change or remove features. We don't guarantee that the app, the web version or sync are always available and uninterrupted, or that every feed works. From time to time a very old version of the app stops being supported and asks you to update.

12. Liability

PodFolio is provided as is. To the extent the law allows, we are not liable for damage caused by slight negligence, by third-party content or services, or by the service being temporarily unavailable. We do not exclude or limit our liability for intent or gross negligence, or where the law, in particular consumer protection law, does not allow it.

13. Term and termination

You can stop using PodFolio at any time: uninstall the app, sign out, or ask us to delete your synced data (see the privacy policy). We may suspend access to our online services for anyone who seriously breaches these terms.

14. Privacy

How we handle personal data is explained in the privacy policy.

15. Changes to these terms

We may update these terms. We will publish the new version on this page with its date, and point out important changes in the app or on the website. If you keep using PodFolio after a change, you accept the new terms; if you don't accept them, you can stop using it.

16. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is Zurich. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may also bring proceedings in the courts of that country.

17. Language

These terms are available in Italian and English. If the two versions differ, the Italian version prevails.
